Types of Divorce and What They Mean

Most people come to the Long Beach Divorce Lawyers and do not know that there are two types of divorce decrees. One type is known as absolute divorce happens when one of the parties engages in misconduct such as cheating on their spouse after they have been married. A limited divorce is one where the couple is separated but still considered legally married.

Once a divorce is decided upon by one party, the first of many steps in a divorce begins. The first step is to file a petition for divorce. This requires that one person initiate this divorce and with this must define a reason why the divorce is to take place. Some reasons include no fault, adultery, abuse and abandonment. Some states do not allow this type of no fault divorce. Some couples just try to use this irreconcilable differences argument to get out of the marriage. Many states reject this plea. While you cannot make these reasons up, try and research your own state to see what the acceptable reasons for divorce are.

The next event that happens after a petition is filed is setting up temporary orders that will help with such things as alimony, child support and more. This order stays in effect until the settlement or divorce trial date. This will help the sopose get through a time where money or bills would be hard to take care of without the other's support.

Next, a process ust be done by messenger to deliver the paperwork to the other spouse. You cannot just hand the person such documents. Teh courts want something in writing to show from a third party company that the paperwork showing a filing for divorce was reached by the other party. Make sure you find a reputable service that maybe someone you know has used as this proof of delivery is key to finalizing the divorce.

Once the petition is received from the service, the other party has a set number of days to respond to the paperwork via the courts. The other spouse could do one of two things: dispute or agree. This is the time for the other person to get a lawyer as you would most likely have one already as you have had the petition served.

Before a trial takes place, the courts and parties involved often try to get te case settled by mediation or between the two parties. If the parties cannot come to an agreement, the court must take the information and decide which might not be the best scenario for the children or parents. A trial might also need to take place which can cost many thousands and may scar friends, relatives or children for some time.
